BOARD OF HEALTH
Meeting Minutes
March 15, 2011
Memorial Town Hall

M. Johnson called the Board of Health Meeting to order at 5:30 PM

WACHUSETT FITNESS POOL VARIANCE:  Brian Forts, Attorney for Wachusett Fitness, represented the applicant.  He presented pictures of the pool, used for training triathlons to for the Board.  He also gave a summary of the issues.

Board Discussion:

M. Ricker inquired if they have a building permit.  A. Crete stated that they did obtain one, and it does require a final Board of Health sign off on the building permit for occupancy.  She informed the Board that even if the Holden Board of Health approved the variance, Wachusett Fitness will still be required to have DEP / State approval.

M. Johnson stated that the BOH approves variances before something is built, not after.  The walkway at one end of the pool is 8”, and 18” on the sides.  M. Johnson would like to get something in writing from D. Lipka, Building Inspector, that he is satisfied with the pool.  He also wanted to review the State Regulations.  Brian Forts provided these to the Board.

A. Crete explained what was being asked of the Board.  Brian Forts said the DEP weighs heavily on the Boards / Local decision.

B. Forts said he would be willing to contact Jack Chandler, Fire Chief, to see if he would be ok with the 18” walkway, to get a stretcher and emergency equipment in if necessary.

M. Ricker motioned a recommendation to table a decision until A. Crete talks to DEP, the EMT’s, and Chief Chandler.  B. Pennino seconded the motion.  All in favor.  TABLED.

FLOOR DRAIN BY-LAW:  J. Zingarelli, DPW, joined the meeting.  He summarized the By-law for the Board.  He pointed out that the State is requiring individual towns to adopt a Floor Drain By-law, and that floor drains cannot be used to discharge hazardous waste/chemicals into the ground.

Board Discussion:

P. Harding, Conservation Agent for the Town, is working on a new Aquifer-By-law, and should be ready soon.  The Board will be given a copy when it passes at May Town Meeting.

M. Johnson suggested the idea of issuing ‘discharge permits’.  J. Zingarelli said it would be the duty of the Board of Health to send letters and check the floor drains.  M. Johnson mentioned penalties for non-compliance.

Concentration of compliance would be in Zone 2.  M. Johnson recommended the By-law be geared to new construction.  He also asked A. Crete to look at the aquifer areas to see if any businesses are in this particular area.

M. Johnson motioned a recommendation to table this until the Zone 2 maps come out.  B. Pennino seconded.  Vote 3-0, TABLED.

M. Johnson would like to see a list of other towns that have adopted this By-law.
